- This is a rent to own contract where you pay rent on this house for 9 1/2 years for $250.00 per month and 100% of your payment goes to the purchase price of the home which is $28,500. Your down payment is in addition to that, making the full purchase price of the home YOUR DOWN PAYMENT + $28,500. This is the absolute lowest payment arrangement I can offer, if you want to pay the home off in less time we have options and can discuss those in detail on an individual basis via email. You can of course pay the full purchase price (your down payment bid + $28,500) and you will be given the deed and title. If you wish to pay for the home in full, email me.
- Your contract is with me. There are no banks involved. When the terms of the contract have been fulfilled by making your on time monthly payments, you will receive the deed and title to the land and home.

Rent to Own ContractWhereas, ______________________ (hereafter Renter) desires to possess and have use of ________________ DeFuniak Springs, FL (land and home) owned by ________________________________ (hereafter Owner).
Whereas, the parties have agreed that the Renter shall take possession of the property on ___________, 2012 and have use of the property, and whereas, Renter and owner intend that ownership of the property shall transfer to Renter upon the full completion of this agreement.
Now, therefore, the parties agree as follows:
Renter shall pay Owner the sum of $____________ dollars down on ______________, 2012. And the sum of $ 250.00 dollars will be paid on the 1st day of each month for 114 months (9 1/2 yrs).
The parties agree that the full $250.00 dollars of each months rent payment goes towards the purchase price of the home.
The parties agrees that the purchase price of the property is $28,500 plus the down payment of $__________.
The parties agree that ownership of the property shall transfer to Renter upon Renter's completion of 114 payments as described above.
Renter must place all utilities for which Renter is responsible in Renters name upon commencement of the term of this agreement and must leave in the Renters name until the this agreement is fulfilled or otherwise terminated. Owner will have no liability if Renter fails to contract or pay for utilities, The parties agree that if the Renter fails to complete the contemplated purchase of the property for any reason, no refunds or credits shall be due Renter.
LATE CHARGES: If rent is not paid within 5 days of the due date, Renter will pay a $10.00 per day late fee. The Owner will provide a notice of the late fee no later than the last day of the rental period immediately following the period in which the default occured. This is not a grace period. If renter fails to make a payment within 30 days of it's due date, Renter agrees to surrender the property to the Owner upon the Owner's demand. Renter agrees that the Owner shall have the right to enter Renter's property for the purpose of taking possession of the rented property.
Renter shall not let or sublet any part of the property until ownership of said property is transferred from Owner to Renter after completion of the terms of this agreement.
Renter shall maintain the property, at Renters expense, in a clean and good working oder. Renter agrees to maintain the exterior of the property, including lawn, trees, shrubs, plants, etc. Maintenance includes: watering, weeding, mowing, air filters being changed for the central air unit.
Renter is responsible for the cost all repairs made to property.
Neither the Owner not any person working for the Owner shall not be held liable to Renter for any damages or injury to Renter or any other person or any personal property on the property or in common areas.
Neither the Owner not any person working for the Owner shall not be held liable to Renter for the acts of any other resident of any other property near the Property, or any person, in the area around the property or common area. Owner is not responsible for any loss due to fire, flood, any damage by water from whatever source, interruptions of utilities, burglary, assault, theft, vandalism or other crimes in or around the property, acts of God or any other cause. Renter acknowledges that no insurance carried by the Owner provides coverage or protection for any property of the Renter or Renters guests.
Renter shall indemnify and hold harmless Owner, or any person working for the Owner, against any and all claims, damages, or actions arising from possession and/ or use of the property (including attorneys fees) as are just of claims of third persons based on conduct or acts of Renter or a family member or guest of Renter.
Renter will not knowingly commit nor consent to any other person knowingly committing a "substantial violation" which means (1) possession, use, sale, distribution or manufacture of a controlled substance; (2) unlawful use of a deadly weapon; (3) unlawful action causing serious physical harm; (4) sexual assault or sexual molestation; (5) entering in the dwelling or vehicle of another person without consent and with the intent to commit theft or assault; (6) theft or attempted theft by use of force; (7) intentional or reckless damage to the property in excess of $1,000. If a substantial violation occurs on the property or within 300 feet of the boundary of the property, under the circumstances described in this paragraph, the Owner may terminate this agreement upon three (3) days written notice and Renter shall surrender property no later than the 3rd day upon receiving said notice.
Absence; Abandonment: If Renter will be absent for more than one full rental period (30 days) and rent is delinquent, this is deemed as abandonment and Owner may take immediate possession of the property without legal process. If this agreement results in abandonment as described above, Owner will store personal property of Renter left on the property for not less than 30 days. If Renter is able to be located, Owner will notify Renter of intent to dispose of the personal property on a date not less than thirty days of the date of notice and include a telephone number and address where the Renter can reasonably reach the Owner in order to retrieve the personal property before the disposition date. The notice will be personally delivered or sent first class mail to Renter at last known address. If the Renter does not retrieve the personal property within the time specified, Owner may dispose of the personal property.
If this agreement terminates by Renters voluntary surrender, Owner will store any personal property for 14 days from the date of surrender. If Renter has not retrieved the personal property after 14 days, Owner may dispose of personal property.
If this agreement terminates by writ of restitution, Owner has no obligation to store any personal property of Renter after 3 days following the execution of the writ of restitution, unless otherwise agreed by the parties.
Owner may charge reasonable storage fees and the prevailing rate of moving fee. Owner will require payment of all storage and moving fees before release of the personal property.
Time is of the essence of this Agreement. This Agreement cannot be modified or cancelled except by a writing signed by all parties. This Agreement is the entire Agreement between the parties and supercedes all prior oral statements
